Medical Malpractice Lawsuit Filed Against Hospital in New York

Tuesday, February 9, 2010

A 33-year-old Bronx woman with cerebral palsy never left St. Luke’s Hospital in uptown Manhattan after going in for a trip to the dentist. According to the New York Daily News, the woman went into respiratory arrest, suffered brain damage, and died three months later of complications from surgery.

Her mother and stepfather are heartbroken and angry and are suing the hospital and dentist for wrongful death. Even though the 33-year-old woman had cerebral palsy, she should have been home hours after having her teeth extracted. The lawsuit was filed in New York State Supreme Court Bronx County seeking unspecified damages.

Medical malpractice lawyers in New York understand that medical malpractice occurs when a provider, usually a doctor or a health care facility, fails to provide treatment that meets the customary standard of health care provided by the medical industry. Medical negligence can include an error in diagnosis, treatment or illness management, and can implicate the doctor, hospital, health facility or government agency that manages the hospital or health care facility.
