Safety rail put up after worker fell at Webb building, police say
According to an article in the Buffalo News published on March 28, several construction workers were putting up a safety railing in the minutes after a coworker fell 30 feet to his death last week in the Webb Building.
The accident on March 20 involved a construction worker, 24-year-old Jonathan Fundalinski, fell from the second floor to the basement at the Webb Building. For at least 20 minutes after the fatal accident, while rescuers attempted to revive Fundalinski, other construction workers frantically worked getting safety rails erected.

New York City Scaffolding Accident Attorneys Fight for Workers' Safety in Construction Site Laws
David H. Perecman, of Perecman & Fanning, was recently quoted in New York’s Daily News regarding lack of safety in construction sites and the increased abuses and injuries that are occurring across New York City. “When a union guy is injured, reports are filed," said David Perecman, a scaffolding accident attorney who represents many immigrant workers. "But when they are illegal aliens, the boss tells them if it still hurts in the morning go to the hospital and tell them you tripped and fell."
Injuries and deaths at construction sites are on the rise. According to the Occupational Safety and Health Administration, since October 2001, at least 98 construction workers have been killed in New York City. Many of these deaths are scaffolding accidents. The accuracy of this number isquestionable considering a vast majority of construction accidents involve immigrant laborers and occur on nonunion jobs. Many of these are believed to go unreported.

New York City Construction Accident Lawyers Lobby for Safer New York State Labor Laws

New Workers' Compensation Bill in New York

On February 27th, Governor Eliot Spitzer, Lieutenant Governor David Paterson and legislative leaders announced an agreement to reform the state’s workers’ compensation system.
According to www.ny.gov: Under the agreement, benefits for injured workers will be increased for the first time in more than a decade, and employer costs, which are among the highest in the nation, will be reduced by 10 to 15 percent with savings to grow over time.

New York Construction Accident Lawyer David Perecman Advises Construction Workers Not to Work in the Snow
David H. Perecman, a veteran New York construction accident lawyer, advises construction workers not to work in the snow and in other unsafe conditions such as winds over 30 MPH.
“Fatalities from construction accidents are already on the rise in New York City and with snow and strong winds, fatalities will only increase further,” says Mr. Perecman, who has successfully represented injured construction workers for nearly three decades and is currently the Treasurer of the New York State Trial Lawyers Association (NYSTLA) and Co-chair of its Labor Law Committee. “Winter and particularly snowy conditions are very dangerous for construction workers, and should be avoided,” advocates Mr. Perecman, who points out that immigrant workers suffer the most from construction accidents and fatalities.
Mr. Perecman also lobbies that New York’s construction and labor laws need to be strengthened. He recently addressed the New York State Assembly and told them that several labor laws are currently outdated and need to be strengthened in order to be effective tools to protect construction workers.
Fatal construction accidents have risen 61 percent in New York City in the year that ended on Sept. 30, 2006, according to the New York Times. In those same 12 months, 17 of the 29 construction workers who died in work-related accidents fell to their deaths. In the previous year, 18 construction workers were killed, 9 in falls, according to The New York Times.
